Obama - Birth Certificate

Well it has been released, and states that he was indeed born in America.  No big surprise there.  However, the nuts/conspiricist/birthers will of course never believe it.  I can hear it now..

'Fake' etc etc etc.  *sighs* I'm telling you, if the big being upstairs (god, buddha, whoever is up there) came down and said in a thundering voice "Obama was born in America" people would STILL doubt it.

Hey, in a way it's good for Obama: his opponents are divided between idiots and sane people. Though, I don't think too many people will continue to doubt it as all those conservative... Speakers? have said that this birth certificate thing is utter BS and that Obama should be blamed for bad policy rather than a dubiously fake birth certificate.

Also, it's been a while, hasn't it, mytical?

Certainly some people will never accept evidence. Like the 9/11 "truthers" and many other leftist movements.

I don't think it's a question in regard to the law, but rather in regard to the rationale behind said rule.

Well it was both really. The whole dispute is pointless, as he certainly wouldn't be elected as president in the first place, moreover he was surely checked...

Well. It is certainly possible to fool such a check. There's a limit where you just have to trust the papers you get into your hands. If you can keep of producing fake papers for long enough, then you've it. Unless everyones birth place and the life they'd lived up until this point would be so unique that it's easy distinguisable, I'm quite certain, these checks, are in the end, always a matter of authority.

The "If it wasn't true, then it wouldn't have happened" is also, in my opinion, not a very nice argument. I used to play a game, known as diablo 2. For a long long time, the Barbarian skill leap, had a secret knockback range, which was very important in pvp, but it was not publicly known. Often when people tried to investigate the possibilities in the pvp scene they'd meet discouraging answers on the form of "if there were something better out there, surely someone would have found it already!". Take in mind it didn't matter if the game at the time was 1 year old, 3 years old or 8 years old. It's a very very bad argument, but most of all, because it doesn't bring anything to the topic in the first place. Everyone are welcome to be conservative, but if something is find or not, is a matter of probability, a probability we don't know, and we don't know at which rate the events of said probability happens. So no matter how long you look, it's never 100%. There do of course exist a point where it seems redicolous to keep looking, but can you actually argument where this point is? When it's 10% chance Obama is Amercian? 1% chance? 0,1% chance? And can you argument for what the likelyness currently actually is? I doubt it's possible without at least knowing the procedures that have taken place so far.

Yeah, but both the parents have to be U.S. nationals. Plus the president has to have been living in the U.S. for 14 years, although its vague and isn't clear as to whether it has to be 14 consecutive years or 14 years in general.

McCain was born the son of two American parents (his father was military) living on an American military base. American military bases are considered to be American soil.

So if locals working as staff on the base have a baby there, that baby becomes American too huh?

Sorry to disappoint Elodin, but the answer is NO.

Actually, US Bases and Consulate abroad are NOT considered US jurisdiction as meant by the 14th Amendment.

According to the Foreign Affairs manual, 7 FAM 1116.1-4 Not Included in the Meaning of "In the United States".
Despite widespread popular belief, U.S. military installations abroad and U.S. diplomatic or consular facilities are not part of the United States within the meaning of the 14th Amendment. A child born on the premises of such a facility is not subject to the jurisdiction of the United States and does not acquire U.S. citizenship by reason of birth.

The citizenship acquired by birth on a military installation or consular facility is through the US Citizenship status of the parents. Also, any births to US citizen overseas must be registered with the consulate or authority on the base.
