A lawsuit perhaps?

As the title states, then I am seriously starting to consider applying for a lawsuit. To some this may seem extreme and foolish and I don't blame you. This is my last option, but Ubisoft is currently pushing me to my limits this time.

This started as the simple case of me not getting the pre-order items, which I was entitled to. Big deal, this has happened to me many times before, but the difference this time is the company behind it all. Yes, I am referring to Ubisoft. For almost a month I have tried to get in contact and explain my situation, which I have tried before. But time after time I have been ignored to a degree, which I think no customer deserves. I honestly feel like a little kid trying to get the attention of grown up watching television. To further worsen the case I haven't heard anything from the moderators/ members working with Blackhole, who was on the case of resolving these issues. I don't blame any of these people since I have heard Ubisoft has some strict obligation, which need cleared in order to inform about anything. On the official Heroes 6 forums it was previously confirmed, that these issues are purely related to Ubisoft as the publisher.

As of today I have almost awaited a response for a month, but the dialogue between me and Ubisoft stretches all the way back to March, where I first contacted them about a concern regarding my order confirmation. At that time I was also having trouble getting in contact with them, but after a few weeks I got a phone number for customer support. Calling customer support on the phone I came to talk with an english speaking man, who ensured me, that the codes would be sent by mail by the time of release date.

As of now I have tried to contact customer support for the 4th-6th time, but haven't received a reply so far. I will wait a week from now and then apply again, but if that one turns out to be a dud as well, then I start looking into a possible lawsuit. I am sorry Blackhole were so unfortunate to get dragged in by Ubisoft, since I really like the Heroes genre and actually think Heroes 6 is one of the better in the genre(Top 2 or 3). And although the game is buggy, then I am so far convinced, that it will eventually be fixed. But if it should come to a lawsuit, then a buggy/broken game + fake advertising from Ubisoft, adds plenty of gas to fuel a fire.

Finally I would like anyone, who has experienced anything like me to raise their voice. Although we are just consumers in a world ruled by money, then we should never forget our right and influence. So please.

I advise you to create a detailed log of every phone call and email you've sent to them.  Since you stated "4th to 6th" time, I am guessing that you don't currently have a log.  Without a log your potential lawsuit will fall completely flat.

However, if you are able to detail out each and every time you've contacted Ubisoft and they didn't respond, then you'd have some ammo for creating an issue.  They'd have no right to take your money.

Have so far made sure to save any mail written to them with replies.

and why did you try to contact BH about that? they have nothing to do with sales... it's all Ubisoft business - and clearly they don't do a good job, but we knew that before

I haven't tried to contact Blackhole, but I remember reading of another guy, who posted something similar regarding the pr-orders on the french forums. And he got the reply, that Ubisoft were the ones responsible.

I totally empathise. It's all a mess. Since I'm just a fan like anyone else, I can promise zilch, but I posted your thread up in the VIP forum where Ubisofters will see it. Hope we can get resolution for your troubles.

I got the same problem as Frederik360. I'm still missing two of my pre-order items (Akasha + Edge of Chaos). I contacted UbiSoft some days after the release of the game but the last mail I got from them is two weeks old and simply said, that they would forward the issue and contact me again. I'm still waiting on any response...

Glad to hear it has been sent to the higher ups, at this point I am just tired of constantly trying to get a hold of customer support. Really just want to get those codes and then get back to playing Heroes 6.

To think that all this mess could simply be avoided if they didn't offer extra ingame content for preorders/collectors.

It could have been avoided if they didn't delegate or ... if they were employing competent people. Snow-ups can happen, that's not a problem, but the least they could do would be to admit it ... would make them more "human" and would make us more willing to be patient and forgiving.

The thing is : you phone them because you have a legit problem, you get "welcomed" by some idiot who you probably disturbed during his coffee pause. Said idiot keeps insisting on the fact that Ubisoft has made no mistake and that in fact, it's YOUR fault ...

I was one of those people who didn't get the digital goodies. I called Ubishop, they told me to call Ubisoft. Ubisoft told me it was DRI's fault, DRI told me it was Ubishop's fault, Ubishop told me it was Ubisoft ... a few days later I got a mail from UbiShop with the goodies with barely any apologies, it was just like "take your crap sucker !".

Yes, yes, a thousand times yes. Especially because these "exlusive" items are just unlocked not downloaded or anything.

Anyway, I'm in the exact same situation and I have contacted the Ubisoft Support the umpteenth time now. They're always very polite and promise to look into the issue and contact the people responsible.
But what do I get the next day? A stock response, the same I got three times now, claiming that the Ubishop support should handle the problem alone.
But Ubishop support can't simply do it, they don't have access to the codes and don't see a problem with the order, because all stuff listed there was delivered.

It's the same situation with the missing Digital Deluxe Edition items, but in that case Ubisoft send all the missing codes without much further hassle. I don't get why they are so stubborn on this topic.

I must say I'm starting to lose sight of the forest for the trees ...

I pre-ordered the boxed Collector's Edition from a local supplier here. Along with it came the Staff of Asha's Eightfold, the Staff of Cleansing, and 4 Heroes: Aguirre, Sveltana, Yume and Kraal. And of course, the precursor map that you play with Sveltana. When checking the contents, it seems these are all for the CE box itself, not because of the preorder I placed.

Which items fall under the pre-order deal? Can anyone detail them? Maybe it has been posted before, but a Google search doesn't yield me any information that's useful. It seems that the information on the internet has been wiped pretty clean about the pre-order deal.

While I sympathize with the idea, I would not advice you to carry on with a law suit. UbiSoft probably have a considerably bigger budget than you have, so I'm not sure I'd go that way. Rather, I'd threaten to get the word around to some online gaming sites and such where you might be able to get a lot of bad publicity their way with a significantly smaller expence from your side.

This could definately be a possibility. Personally the first site that comes to mind is IGN, which is my preferred website for all gaming related. Perhaps anyone would like to participate in this, which could involve writing on both their twitter accounts and on the My IGN pages. Kotaku could be another example.

Ubisoft has received a lot of bad publicity over the past few years and you still bought their game.
I don't think that will accomplish much either.
