Yes but the art style of H5 was done by Nival independently from Ubisoft (at least until Tribes of the East). Back then Ashan was still in flux (it only started to fully appear with Dark Messiah and Tribes of the East). Long story short, from a visual point of view most units from H5 are not considered IP-compliant.
But couldn't you do the same to lich as you did with the grim reaper? To me it seemed like you took the necromancer hero from h5 as inspiration and made from scratch with your take on it. While I'm against recycling, copying some of the most hated models is even far worse. At least haven feels and looks different as they feel like you truly worked on them(and they weren't that bad in h6 either). The necro elite is like my worst nightmare for the faction as they easily seemed the most hated designs on forums and between my friends. Especially the lich that doesn't even remind me of one(only flying gives any idea that it's magical and the idea itself seemed so odd to me). All past games have had some designs I've disliked/hated, but at least they show effort. Re-using hated model just seems lazyness and saying you guys loved h6 (total excuse to me) shows either lack of understanding of fans or that you think that we are complete idiots. We hated it back then, but surely we'll love it this time if green is turned purple? C'mon...
PS Retcon is for me one of the worst things you can do, but the namtaru poison making liches/vampires was totally off and would actually love to see it retconned. Heck, make the spider stuff more of backstory like in h5 not the centerpiece like h6. By reading the blog and forums you'd know that most people want the old type of necromancy, not a spider-cult full of pretty people drinking suspicious liquid  (and yes I was generalizing, I'm sure some people love that stuff too)

H8 most definetly must shakes the foundations of Ashan. Be through DM, new continent, world or whatever.

Female Sea Elves as neutrals?
Really? They can't come up with something more fitting than a sea elf?
Draugr? (Sea Undead that can become big and have powers over weather, often undead pirates/barbarians)
Siyokoy? (Extremly freaky mermen that can also walk on land, think of a monstrous version of the merman fighter from Darkstalkers fighting game Rikuo)
NO it has to be a boring beautiful girl sea elf, we already have 2 towns full of elves.

And as for units we'll surprisingly get mix of h6 and h7 creatures. What doesn't make into line-ups is added as neutral(via DLC naturally!). A masterpiece in the making!

Then go prepare your spam. Since Heroes 2 every game features Elementals, there is little doubt in my mind that they don't intend to break this rule, as Elementals are by far the easiest, most recognisable and neutrallest neutrals there are.

Elementals belong to HoMM, there's always a place for them in the lore, and the world wherein the game takes place.
So you really want to go on a spamming spree just because you don't like elementals? That's...childish, boring, and cheap.

Speaking about neutrals, do you hope for comeback of phoenixes to the neutrals? Their status after Sylvan lineup voting is hung and I really want them to come back as Prime magic neutrals, maybe in a little bit changed colour scheme.

If they are reusing HVI assets I don't see why wouldn't they reskin HVI phoenix and use it as one more neutral.

The fact that we're getting all this snowing because ome unit doesnt have a skull as ahead, and to make it worse you can only tell if you have super zoom.
