This is, by the way, why federal justices serve for life. Really shows the genius of those who wrote the US Constitution.

The fact that you are a fascist does not make you a criminal, so feel free to think like you do.

It just makes you incredibly dislikeable. Take care.

Well, differently from you, I've got plenty of friends who do love me, a nice girl and a caring family. snow you and your miserable existence.

Seeing someone so openly and proudly totalitarian got me a bit heated, better to steer away from that on this topic. Plenty of other things to talk about.

The irony is that Republicans supposedly are the party of states's rights. Just goes to show you that GOP doesnt stand for anything anymore.

I was just thinking the same thing. I always thought Republicans were heavy on the states rights, but I guess it is all gone now.

I like how prejudicial this line of thought is, the whole point of asking for that hearing was for SCOTUS to take a stand regarding other states taking actions against the constitution and thus damaging the other states' rights for proper representation at the highest office.

If what they're alleging was true it would indeed be a violation of their rights, the system is built to ensure that equal and fair representation is given to all states, even if they are less densely populated or less wealthier.

And if this was true you're basically arguing that other states have a right to ignore constitutional law and proper procedures and even commit fraud, so you're basically arguing from the most radical states right perspective, which is commendable, and thus you have to agree that states have a right to secession.

This lawsuit may have not had enough standing, but it wasn't an hypocritical move.

To my understanding reading the lawsuit Texas is arguing that those four states have acted against their own constitutions and have enacted legislation in an irregular way, legislation that they argue gave an unfair advantage to the other party, and they request the highest court for a resolution of said irregularity.

If such actions incur in damage to themselves, isn't it then a state's right to argue for fairness to themselves?

I'm just saying that from these premises, the GOP is still arguing from a state's right point of view and accusing them of hypocrisy is in my opinion dishonest, that's really what I took issue with.

The GOP party within states such as Pennsylvania and Wisconsin would be the most likely and the most appropriate group to file a lawsuit if the state was not following its own state constitution or the US constitution (and to be clear, the arguments they are making are garbage, although it is legally within their right to light their money on fire with legal fees).

These other states joining together to file the lawsuit are demonstrating collective sulking, but that is what happens when loyalty to the president surpasses any sort of a conviction in a platform.

The argument made can be transferred to the other states that feel they are damaged. Just as the defendant states can be joined by others that feel that a ruling in favour of Texas would damage their own rights.

Again, I'm talking about this not being a contradiction for arguing for state rights.

@Neraus:

I wasn't the one who said that.

Correct, if there was actually something unconstitutional going on then it's not anti-state rights if another state happens to file a lawsuit over it, especially since a general election affects the entire country, although it is very curious that the lawsuit wouldn't come from within the state itself.

Probably has something to do with the fact that the lawsuit is a joke and the GOP within states such as PA and WI don't want to suffer blowback from their constituency a month after the general election. That's why the lawsuit is coming from solidly red states for the most part.

It would seem that the office of federal judge has a lot of gravitas rubbing off of their holders, because party affiliation doesn't seem to matter a lot or at least way less than the current president thought. Somewhat reassuring for the state of democracy in the US.

I know you weren't the one saying that, I just wanted to clarify I'm not arguing on the merits of the lawsuit, since it's legal matters and I don't want to get dragged into the bog. Just playing devil's advocate for the GOP.

@ Neraus
This is the brief:
Quote:
155, ORIG.   TEXAS V. PENNSYLVANIA, ET AL.The State of Texas’s motion for leave to file a bill of  complaint is denied for lack of standing under Article III of  the Constitution.  Texas has not demonstrated a judicially cognizable interest in the manner in which another State  conducts its elections.   All other pending motions are dismissed as moot.

It means that the Scotus says that a State has no business with the way another State conducts its election - which makes a lot of sense, if you think about it.

Well yes, they are appointed. What I mean is, unlike other political appointees, they cannot be easily removed, which protects them from political interference. The kind of funny thing is, that the SCOTUS has a 6-3 conservative majority now, 3 of them appointed by Trump. And they are largely Originalists and Federalists, the same kind of jurist philosophy that would be inclined to summarily reject the bonkers legal arguments that the campaign was arguing. Basically Trump forged the very sword that decapitated any hope he had to overturn the election in the courts. What his campaign is trying to do is the very antithesis of federalism and political conservatism, something that seems to be lost on his GOP followers.
