A new topic would be a good idea. With your thread describing your steps to obtain your codes, this thread is probably obsolete anyway.
One last point before we migrate to the Off-Topic forum:
Nintendo is great at innovating new ways to interface with your game. But ultimately, that's no different from adding new peripherals to an existing system. And Nintendo doesn't create enough strong content to warrant an entire console. Their games tend to be geared toward younger audiences and families, along with two or three games per system that the die-hard fans will always want.
If Nintendo stopped spending so much of their efforts building a new system that is only slightly better than the last generation of consoles, and started working more on creating strong content for other systems and ways to incorporate new peripherals for those systems, they would probably do just as well, and the consumer wouldn't have to spend three-hundred dollars every few years on a third system that will only yield maybe four games worth owning over the course of the console's lifetime.
I've been a big fan of Nintendo since I can remember, but you're right - thinking about it, there are only a few Nintendo games that I get excited for anymore, and if they existed on other consoles that would make them more appealing.

I do understand flyingpenut's point. A law suit is not practical as an individual. I do think it could go to a small claims courts in the US, but their lawyer would likely trash you if you were unrepresented. A class action would be the only way a lawyer would take it up.
I say it is not practical for a couple of reasons. It is mostly not a practical way to get your codes. It's not that the company is even afraid you will win. They also don't want thousands of dollars in legal fees. The bigger threat to them is if you would turn the evidence over to legal authorities and they would be threatened with large fines.
Still, in my case, all this does is make them hurry up and give me a refund. If Gamersgate cannot get the codes from Ubi, then they just can't. I have to be careful if I want to keep them motivated in the direction of trying. That is why I am trying to find others in the same situation who bought from Gamersgate.
All this having been said, here is where I can see flyingpenut's point:
I have spent hours online and on the phone to get two codes that I rightfully am owed for pre-ordering a month in advance. These codes cost the gaming companies nothing. It may have cost them something to program them originally, but handing over the physical activation codes will cost them nothing, as you cannot "buy" them. It is costing me hours to get what was a "bonus". If I had bought a special edition with these items, that special edition would have cost me no more than $5 more. In fact the Deluxe Edition came with many more bonuses and still only cost $5 more. My time is worth something. I have paid them quite a bit more than their mistake will cost them. I will say that if there were some way to activate these items that were "unofficial" it would be in my best interest to take that option, saving my record of evidence if ever I were pursued for taking the "unofficial" path to unlock my items. At one point, I had posted something that asked if these codes really were unique and if there were any way to just end this. I then edited the post within the next couple minutes.
Now, that is different than stealing an entire game that you had not even purchased before. The example cited was a far stretch in my opinion. The game was not "playable" druing the 1 week window you wanted it for. You had the option to play it later, but did not want to anymore. So, you steal an entirely different game later on. Good luck explaining that one if ever you were caught. It goes beyond logic and into psychological justification. 
Anyway, whatever happens, in the end I lose by having taken the proverbial high road. I have lost and continue to lose much valuable time at the very least. I just lose much worse if I don't end up getting my codes. This is why, if Gamersgate gives up trying to get the codes, I hope to contact someone in Ubisoft (i.e. a Heroes developer) who might actually care. Someone who, if moved by pity, could have the pull to easily get the codes and give them to me. Alas, it is just a dream and I continue beating my head against the brick wall, rejoicing when I see I left a scratch on the surface.

Purefun, trust me I have taken the proverbial high road more times than you know. I just got fed up with getting screwed over and took matters into my own hands. All of these options everyone is saying do not work. You can't sue em. You can't bluff them. I have tried many times. I tell them me and other people will not buy their games anymore but honestly that is a lie too. If HOMM3 had of screwed you over you still would have bought IV. I resorted to the only option left for me other than letting them screw me.
Oh and you say I could have played the game later but it was a hot seat multiplayer game that I only enjoy with my overseas friend. I never would have bought the game if I couldn't play it that week. Therefore they really did take my money and I got nothing in return. Let me give you a similar situation. Say you buy a salad with dinner but they don't bring it to you until after your meal and you are full. Well they tell you no refund because you can still eat it. But you are full therefore would get no enjoyment from the salad now.

No, it's more like if you go to a restaurant and order a salad with your dinner, but when they bring it to you it has no dressing - and then when you get your cheeseburger, it has balsamic vinegar on the fries. 
And then they say, "You said you wanted dressing, you never said you wanted it on your salad."
You can complain to the manager, and maybe they'll take it off the check, bring you a new burger and salad, and everybody leaves happy more or less.
But you don't not pay for the salad if it's on your bill. You don't go into the kitchen and steal all the silverware, you don't sneak into the restaurant after closing time and rob the tills, you don't tell people to dine-and-ditch when eating at that restaurant.
Why?
Because it's illegal. What about that is so hard to understand?
I mean, yes, I get it, you got screwed, and that sucks, and I'm sorry that happened and you weren't able to get it resolved. But when you commit a theft, it's still stealing.
In the end, do what you like. But don't tell other people to commit the same crime. Not here.

I haven't bought H6, I will wait one or two years until it is worth playing it, now it is a B- game for me. But I have something to say about that topic (it may sound like an advertising but I don't have any connection to that company except for being their customer):
From 4 years I am using PayPal, always. I am not paying directly with my credit cards, because if something messes up with the order (and I am ordering a lot via internet), I have to deal with this alone.
I find out how quick and with how much pressure they are dealing with these on the other side of the order - I had 6 cases in the past years where I had to complain about an order (and I had hundreds of orders paid meanwhile, so it is not so much problems I have with internet orders) - once it was my mistake paying in euros instead of dollars for few paintings and the seller didn't answer me for 2 weeks to make it right and in 2 hours after complaining to PayPal I got my money back. I had subscribed to a file-sharing website, where you have to pay $9 per month - I had to upload a huge photo collection for someone over the Earth - and it was the only way to do it - but than I found out I was subscribed for them to pay every month (and I needed that only once), I got my money back for 2 months (I haven't paid notice that $18 were withdrawn meanwhile). And at last - in similar case I ordered a game from Steam as I usually do but it was without the fancy bonus - I got my money back and I lost the registration code as if I never bought the game - it was 3 weeks after the order - yes, I have played the game for that time, it was a boring and poor created game and I was happy I didn't get the bonus features - again in few hours (not days) the issue was fixed by PayPal.
The point here is that you don't have a chance playing alone vs. big companies or even a single vendor if he is not respecting the rules. If you want to win against them, find a committee, agency or even a non-government foundation that protects the consumer's rights. Leave it to them, some of these in Europe are real wolves and if they spot an interest for them, they will help you.

Ok Ill take your expample AOSAW. But what you forgot is that yes they did fix my order but i had to wait two hours to get it. Therefore i recieved no enjoyment from that cheeseburger and salad because i was starving and tired by the time i got it. Not to mention that i was two hours late getting home and had to pay the babysitter $40 extra dollars. Now that bad restaurant forced me to pay $60 for something that should had cost $20 and i also sis not recieve the enjoyment from the meal.
All im trying to get through is that you shouldnt always do what is legal, you should do what is right. I have proven that legal and right are two different things in previous posts, so we need to stop being so scared of the big guys and stand up for ourselves.
