US Government and there God attiude (long)
This is something that has happened to a close family member of mine and I just thought it needed to be shared and to let everyone out there know that the US goverment isn't all that people make it our to be.......instead of innocent till proven guilty you are guilty until proven innocent.
Well this is a long story to share but I need to vent somewhere.....
3 years ago I begun a loosing battle with WV CPS. My oldest son, had fell on x-mas day and busted his head open. I took him to the ER and had him treated. On Jan 2nd 2001 CPS came and took my son, due to the fact of me having no medical insureance, so they clam. I asked them a week later on why they removed my son from my custody they then tole be, because of the calls they had gotten. They calls were from my husbands aunt and cousin. The reason the calls were made were because I had had the cousin removed from my home for being drunk and loud around my then sleeping 3 year old son. Well the police then showed to my home after I had called them to remove the cousin. He left peacefully until he got outside. He them attacked the officer, and was arrested. Well it wasn't 20 minutes later the aunt called my home and told me that I would regret the day I had her son arrested. It was not even 2 days later CPS came knocking on my door telling me they had gotten a call saying.....
1: My son was strapped in a car seat all the time
2: He was crawling in cat urine a fecies
3: We did not feed our son
4: Our son was over weight
5: Our house was messy
I then had to go through and explain my life to the CPS workers. They asked about my childhood and I told them I had a few depression problems when I was younger. They then proceeded to tell me I had Manic Depression. Toward the end of there vist I asked them what was wrong, the then said all the remarks in the call were correct. I then asked the worker(Katy Fox) how could they all be true when they all more or less contradicted eachother. She then told me to stop avoiding that I have not done wrong and stormed out of my home. I got a call later in the week telling me to make a doctors appoint ment when a theropist, well the doctor I wanted to see her office was closed, being this was on a friday. Moday moring Katy Fox showed up at my home while me and my son were napping, picked up my phone and phone book threw them on my lap and told me she was not leaving my home until I called the doctor, then I tole her you will NOT come to my home and tell me what I can and cannot do, I asked her politely to leave my home. She left, then came back 3 days later telling me that CPS opened a case on me. Well we had our first heating in front of Judge Fox. To make a long story short we battled for 3 years with CPS and be lost.
Now for the second part. I had a son on Aug 2002, by C-Section due to an emergancy for the babys well being. 1 hour after I got out of recovery CPS stormed into my room and told me they were taking custody of my infant. The nurse then told CPS to get out of this room now. I went into shock because of this...I over heard the nurse tell the CPS worker she could have killed me. The little parts of this story are.....
1: My son was born in a diffrent county
2: I singed a paper giving custody of the infant over the second he was removed from my stomach
CPS jummped county line to take my son, which is NOT allowed, I have looked this up. The county the child was born in a resides in has to investogate. Then they took a child that I didn't have custody of to begin with. Well my son is now 13 months old and just this past Friday I was told the terminated my rights with him as well.
There were so many rules in this case that were broken, and I know I have not told them all but I just needed to vent about this with people who have went through the same things I am dealing with now. I will share more with you as time goes by and I hope to find some peace by sharing my story.

Well, I have often heard that the USA is the most undemocratic democratic country on earth.
(Yes, the sentence is correctly spelled)
This is just one other case that confirms it.

The sad part is....That CPS gets involved and takes kids away from innocent parents. Then they do not investiagte the parents that end up killing their kids. I know of 26 children that have died by the hads of their parents since my famliy member has had this stuff happen. It is just so crazy. WHY should they government have a right to say who should or shouldn't have children if they are not going to be involed in all cases? It is just plain out right over bearing if you ask me.

If they dont have any evidence of wrong doing, besides their mental opinions, then I do feel for you. Unfortunately there is a gap, and your forced to prove your innocence.
Menaing, if they dont have factual evidence equal to a liable charge, then there may be a problem with the system and I would uprise to the heat of government to make that clear for you, and the rest of the world, if I had a way for him to listen.
1nce again, factual evidence leading to "guilty"
Holding your son in their custody, may not be a punishment but a precaution and you need to work the court system fast to be proven inocent enough to not be proven guilty.
PS i feel in most of these cases it would be more *for the people by the people* if they let families stay united until reasonable guilt has been proven.

Thats messed up. It sounds like that lady (aunt?) needs to get a life. Well if I was you I would get a lawyer.

wait they took ur son without investigating? if im correct, that is illeagal, so u can sue them, take ur kids bak, get $ from them... all u need is a good lawyer... c i watch law and order so i know my stuff

Well needless to say this family member does have a lawyer 2 as a matter of fact. 1 is state appointed the other they pay 150 dollars an hour, plus had to pay 1,000 down. The CPS people have broken law after law and the judge just let them go ahead and do it. The legal system of the united states is just messed up

I reliaze your situation. Use the $150 1, but only if you make it clear that you are in desprate need of his help. Tell him, "look, i want this as quick as possible, because there is nothing wrong. It's infair from the court sys to take this from me!! Please tell them, that until they have circumstancial evidence, that I am not guilty enough for them to have circumstancial evidence enough to do this much!!"
If the judge, and lawer do not feeze up to your situation, then america can be known as
"We say guilty until prooven and justice is served, but unknown circumstances dont require proof."
that, if america says, is needed to be looked upon in relation to our modest "inocent until proven guilty" Then, we have contradicted our national meanings with our contradiction of our law.

My neice has been battling for 3 years with this stuff. She has not seen her oldest son in over 6 months now and just lost her baby. There is nothing more anyone can do until these cases go to appeals courts. the Judges in her town are so corrupt it isn't funny. I know of atleast 15 laws CPS and the Judge broke in her case and I think it is totally unfair. You know when she does get her children back, they are not even going to recognise her anymore, it is just unfair. I do NOT see how the people of the united states can let this stuff happen, I used to be proud of my country till the did this to my family!

id try an help u any way i can...
listen, i have stuff u can say 2 them, or even the Police, ur aunt probably phonned the CPS people, told them all that false stuff, which is considered filing a false report, major crime, just that could ruin the CPS's entire case, false evidence, false case, then they went into another country without a warrant, another major crime, any place they searched that belongs 2 u without a warrant can in a case make it so that they had no right 2 search, which means they dont know if anything is rong, so u c they cant possibly have a case... good old america *cough cough* by the way im american...

(okay please dont mind me losing my temper)THEY DONT NEED A WARRANT WHAT KIND OF PEOPLE ARE THEY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! THEY R TOTTALY MESSING WITH THE JUSTICE SYSTEM!!!!!!!!! still though, they cant take children on false charges can they? D*** AMERICA... I THOUGHT AMERICA WAS FAIR WHEN IT CAME 2 CHILREN RIGHTS!!! well, i have an idea, send a letter to the newpaper, 2 the president, govener and those people, let them see what they do, if they promise 2 stop it, tell them that, they will b voted more often becuase they are helping chilren survive!!!
okay ive cooled down had 2 get it off my chest i feel some much bettr now

I guess the CPS just doesn't follow the rules. You should sue them, it is possible. A friend of mine successfully sued the IRS once. He did have like 5 lawyers but he did it. Bounty, I don't think your mail letters idea might work. First of all people ignore this kind of stuff. America does really have some ****** up laws. Alot of the system is corrupt. Second of all, this probably happens all the time (not sure tho). Mailing a letter might work but it is unlikly. I think the best odds are to sue, which can get pricey.

well sueing will work, first u sue ur aunt person 4 filing false report, get her arrested and get $ from her, then u sue CPS 4 not investigating the false stuff about ur house and stuff get even more $ and everything will b back 2 normal.... also sue them 4 leaving the country 4 take some1 (that 4 sure is a crime a bad 1 2, 4 that u really need a warant...)

It's kinda hard to prove that somebody filled a false report.
Either do what they tell you to do, or sue. I guess those are your only options

well sometimes proving a false reporrt is ez, havent u guys ever seen blue streak? good movie but the guy only needed to open a door and boom... stolen goods were hidden in a truck

That is a movie...
How do you prove that somebody filled a false report. They are technically innocent until proven guilty. So you have to prove that they are wrong, they don't have to prove anything.

well i dunno, i guess movie stuff doesnt mattr here does it... get a P.I private investigator or something, i mean look, kittenangle got a threat from here aunt, then next day CPS got a call, cant u like go 2 the police and suppena (spelled rong, means get something forced by law or suffer) the file on who filed the call about kittenangle?

You cannont prove anything to be faule accusations because CPS will NOT give the name of the person who called. AS for the letters to the press and government officials my neice is doing that as we speake. We are rasing awareness on what CPS does and the laws they break.
