My friend wants to create town which had monsters from diablo 2 game

Well... this is probably possible, but as i know diablo monsters have different view projection (not the same as in heroes).

I am actually right at this moment about to extract some monsters from Diablo 2, when I get them I shall post them up and perhaps you can do as you see fit with them.
But is it illegal to take their monsters out and use them with a different game?

I already extracted some of them sometime ago and as i remember they dont fit correctly.

well its all going fine. need to remake minions of terror and destruction and make demon rascal and tricster.tragOul,lister the tormentor is minion of destruction but it is elite monster of baal's elite 5.the biggest problem is getting mephisto,asmodan and belial portraits.also i need to get the soundtrack of diablo2 to play an intro track in the town. i won't use rock to this town it will be ridiculous compared that all music in Homm3 is clasical type.another thing is with 7th lvl building. it will be gothic style church but the only building gothic style is diablos chaos sanctuary and i can take only one part of it at the time.if you have to find few gothic style church photos send em to me my skype is kipshasz.

Sorry, it's only my opinion. I just don't like apes in Diablo. Maybe you will draw it better .
