My son-in-law just learned "today" about a new law that will be enacted on Jan. 1 He has a very young child in 1st grade.

yep, and it'll spread. count on it. all this sissification of society and pandering to people who's spines can't handle real life, will really take it's toll on people. among other things. the snow'll pile up until everyone'll need a snorkel to breathe.

this is what happens when you let soccer moms with their precious little snow-ass offspring give their opinion on any goddamn thing; and have people kowtowed enough, or stupid enough, to listen to those idiots.

I'm torn. On the one hand that's at least acknowledging an issue. On the other, this is a terrible way of dealing with it and you just know it's gonna hit non-white perpetrators much harder.

I wouldn't mind improved sanctions of completely rude behavior on schools, but in the form of public service or something.

To prison?....you'll scar a kid for live and breed new criminals

Indeed, very harsh way to deal with a matter which might be and should be educated at home. Most of these 'would-be-criminals' lacks proper education, which may either be too violent or strict demeanor or too slack letting them go rampage and bully everyone.

Around here, we are often being torn between the lowering of the penal age limit from 18 to 16 or 14, given our laws are too soft on criminals with that age who commit terrible crimes (not really school fights, of course). That law would perhaps be a bit of use in these cases, not on little kids and their families.

This is simple. Give back teachers and family full authority over kids. Some will apply it wrong but most of them will do it right, train them properly so they know how to handle violence. When I was in school, I wouldn't blink an eye, because teachers were allowed to punish me all the ways they wanted and they did if trouble, then also they would call my parents and at home it was double worse.

Kids can be very violent then school is the place where education is performed and consolidated. NOT always at home, because parents have to work, while teachers are payed to educate. If it isn't done, then only prison can substitute, as the priority is protecting people from violent people, not be nice to violent people.

If the article is accurate and not misinterpreting a technlcality or something, this is one of those laws that, de facto, 99 percent of the people will ignore, including the cops themselves. Nobody will report school kids for fighting if the consequence is jail time. I mean, I was one of the most non-violent, book worm kids you could ever know and even I remember getting mixed up in a few fights, there is almost no boy who does not get physical once or twice through elementry/high-school. The law is not executable.

Hmmm, well, that is possible but kid fights rarely come to such arm breaking levels, do they? Besides if your neighbor's kid was going to get jailed and get a permanent record for such  a thing, you may still think twice.

From what I understand, the law only upgrades the felony degree, so now the highest punishment possible is, indeed, prison. But it doesn't change the way is applied as elsewhere, which means you will get max punishment for really harmful injury. In general schools, especially privates one, never complain to authorities about violence, because that means financial loss, so they always try to solve the case inside. But if the injury is indeed grave, or if there is firearm triggered, then the doctors have to report authorities.

What is not specified is the minimum age, and thats rather disturbing. But also it would be crazy to suppose the judges will have a mental seizure and jail 8 yo kids.

It says " If he or she knowingly causes physical injury to another person (hits someone or has a fight with another individual and an injury occurs)" so, anything from a twisted ankle to a black-eye may suffice.

How can you charge some children(as it was  stated "regardless of age or grade")as criminals? Man, children have to learn what to do and what not. But that's  a normal process of trial and error. Meaning, they have to do things wrong to learn what's right.

This. USA has by far the highest percentage of incarceration just because it means business. And they still claim they defend "feedom" compared to such countries as Russia or China.

of course, this will just mean that kids will fight out of sight/off school grounds. there wasn't many fights in regular school, on school grounds(outside elementary school). i remember once facing off with a kid after school at a 7-11(he picked the place; i had picked something out of the public eye, which he declined). so kids will just be more careful about being impatient and going nuts on school grounds. really, the law is retarded on so many levels. i don't even know why i was initially so pissed off. chalk it up to my reactionary american heritage.

If you view a bald eagle at the zoo, you are looking at the American symbol of freedom in captivity.

But really though, the issue that this law tries to address is real, but it's trying to solve it in a stupid way on an unnecessarily big scale.

Children of any age? Might as well put a 6 year old in prison. I mean, he's definitely mature enough to know what's right and wrong, what causes harm, he's mature enough to understand that his possibly 4 years in prison for the act that he well enough understands was wrong and harmful, are well deserved. /sarcasm

I have my share of stupid things I see every day, but this one truly takes the cake.

P.S Yes look at me, the immature kid of HC, talking about maturity. Rich as it sounds, I think most would agree that what I said is common knowledge.
