Richer members of the World Trade Organization (WTO) blocked a push by over 80 developing countries on Wednesday (10 March) to waive patent rights in an effort to boost production of COVID-19 vaccines for poor nations.

Like with many things in the pandemic, it brings attention to something that has been a problem for decades.

It took S. Africa a decade to get off foreign dependence on drugs to treat AIDS while their people were dying by the thousands. No ability to manufacture a generic treatment.

An even bigger atrocity than with these pharamceuticals (although "mass murder" might be more accurate and appropriate) are various laws and "trade agreements" that restrict GMO agriculture while food supply and nutritional deficiencies continue to affect billions of people, many of them under the age of 18. We're one of the first generations of people on the planet to voluntarily devolve in our application of scientific knowledge, but that sort of goes beyond the scope of the thread I guess. It's one of those things where it was easier not to know about it.

It's such a joke here in the UK, in my college I keep hearing people getting asked repeatedly: Which vaccine did you take ? Astrozeneca, Pfeizer, Moderna ? It's even a competition in terms of what did you choose to take to save your life (many of my colleagues and some of the staff have asthma or other respiratory illnesses, so it's such a sick joke).

Even if I said I'd vaccinate myself with the Sputnik vaccine, no-one would give a sh1t unless it's theirs. They don't even care about efficiency, morals, or anything along those lines. Gotta love capitalism.

Not sure I understand what's wrong here. They hold patents for vaccines which they refused to waive, therefore villains, greed before the greater good, etc. Is it ever that simple?

Well, read the article blizz linked, it’s a pretty good summary. Besides that, the health sector isnt comparable to other sectors in this regard, it’s life or death, so yes, you can say ‘it’s within their rights” but the vote is about recognizing an extraordinary circumstance and although extreme majority of countries support applying this notion to law, they cant because they need full consensus. So, it’s an opportunist block.

Once, there was this drug company CEO who raised prices of AIDS medicine to absurd levels. And some supporters of neo-liberal logic here simply went “hey, he has the right, he doesnt have to care, it’s the smart move” etc, but then the company got boycotted so hard, the guy got fired and they lost a lot of money, too. The point is, when it comes to matters of life and death, rules change, because all “rights” exist as long as masses agree to them and obey them. They are socially constructed, they exist because society agrees that they should exist, just like once they agreed that slavery or noble birth rights existed. If you push these rights too far or treat them as loop holes to feed inequality on a level that is grotesque, you will simply have revolts, social chaos, terror attacks and all sorts of “karma” coming back at you. So even on a pragmatic level, this is dumb, put aside the lack of empathy.

Kind of makes me wonder what would happen if these 100+ countries just completely ignored the [illegitimate] law and started producing generic and vaccinating people. Not just one country but if they all just started making generic together, at least whoever has the ability to do so. You can retaliate if one country goes out of line but if the vast majority just completely ignores the law and does what they need to do to protect their people there's not really any efficacious way to enforce the law or retaliate without hurting yourself. The opportunist nations can threaten to stop producing patents for them in the future but since they would be cutting themselves off from a huge portion of their market that would hurt them even more. You can't retaliate to over half the planet. The supermajority would have the most leverage if they simultaneously practiced civil disobedience.

The pandemic of the century supposedly still doesn't qualify as an extraordinary circumstance, which begs the question why that stipulation in the document even exists at all. Apparently there needs to be weaponized smallpox or something that is exterminating entire cities of people before developing countries are permitted by the nobility to produce a generic to protect the health and lives of their population.

It's an illegitimate law. An apartheid. There's no reason for it to be obeyed but it probably will be or there will be further consequences. If the supermajority just ignored the law simultaneously nobody would really be able to do much about it, but probably nobody will make the first move.

Thank you for your support. There hasn't been a pandemic on this scale since 1918. S. Africa was an appropriate country to lead this issue considering they are currently dealing with a more infectious variant in their borders that is killing people.

Patent rights related to a pandemic vaccine is just a matter of scale. The more fundamental question is: Should we be able to patent pharmaceuticals at all? Those who say no must then address the obvious problem: who will manufacture new life saving technologies without getting paid for it?
