With a fire-immune cabir, a fire-immune priest, a fire-immune rhinocerus and a fire-immune champion dealing half damage to each other, watching a fight between fortress armies is gonna be a delight 
What a silly design in a game where t4 armageddon or more or less guaranteed. I'm not talking about the cabir but the liberal use of fire immunity in general. Not only unimaginative but also bad for gameplay.

As far as I know, it's not about the name. It's because of the designs.

The resemblance is uncanny. Some companies protect everything even remotely connected with their creations and since we talk about entertainment company... Overprotection at its finest.

So? H3 gremlins looked nothing like that. And heroes artwork has changed to a large degree since H5 as many things were not set in stone at the time. They could easily change the design if they wanted to.

So, wait a second. You are saying that the licencing problem with the name Gremlin was because of the design they made in the fifth installment and not because the creature itself was patented?
I mean, we know that the name beholder as well as something resembling the traditional look of that unit cannot exist outside the D&D universe as well as the Hobbit and the LOTR universe and i thought something similar was true for the Gremlin as well.
So, in the end, it is because of the design and not the name that Gremlins are not in the game now?
Also, i would much more appreciate some resistances than total immunities in any faction.

As I said, I don't exactly remember the details. Could be that's just the belief and the real reason is not explained.

no it was only changed because of Erwin pedantry,
first they were forced to redesign the creature to apologise for their plagiarism in Heroes 5, then Team Erwin decided hey they can't possibly be gremlins because they don't look like gremlins and gremlins are supposed to sabotage machines not repair them (lol sigh lol), so they tried to rename it to cabeiri,
except because Team Erwin is illiterate and cannot spell it was butchered to cabir, then after all that they added in lore that cabirs are called gremlins in Ashcan because they are clumsy despite not naming the creature gremlin, it is like a sketch from the Three Stooges if you ask me lol

Well, worst case scenario, an imported cabeiri that is more brownish or greyish and has cosmetic changes to it and more of a slave outfit can be moved to Academy and renamed as gremlins and the normal Cabir we have now in the game can replace the kobold and get new abilities.
